The Class Action Lawsuit Against WEN

You might have heard about the beauty brand WEN and its cleansing conditioners. If you are not familiar with the product, you’ve probably come across the brand’s infomercials. WEN is a hair care products designed by Chaz Dean. It alleges its products are sulfate-free and will strengthen, protect, nourish and revitalize hair using a blend of specialized herbs and other natural ingredients.

Class Action Lawsuit 

A class action lawsuit was filed against Guthy-Renker, LLC and WEN by Chaz Dean, Inc., alleging that WEN products can cause severe hair damage, scalp irritation, and rashes. WEN has denied the claims. They stand behind their product.

A settlement of $26,250,000 was given to settle every person living in the United States and its territories who bought and/or used a WEN product between November 1, 2007 and September 19, 2016. This settlement is a way to avoid a costly trial for all parties.

How To File

To file, go to the official WEN settlement website: www.wenclasssettlement.com. You will have to choose whether Tier 1 or 2 suits your individual case. The deadline to file a claim is April 28, 2017. If you choose to exclude yourself from the settlement and present a lawsuit at a later time, then you can opt out. The deadline to opt out is February 10, 2017. Settlements will range from $25 to $20,000 – depending on which tier you file under and the scope of your damages.

It is crucial to consider this settlement as your inaction to file a claim or exclude yourself, will prevent you from filing any claims in the future. And if you were damaged in any way, you will want to be fairly compensated.

The United States District Court for the Central District of California will hold a final approval hearing of the settlement on June 5, 2017.

The Food and Drug Administration (FDA) is also investigating these allegations.
